These Terms of Service ("Terms") govern your use of the GreenBrain platform operated by GreenBrain ("we", "us", "our"). By accessing or using GreenBrain, you agree to be bound by these Terms.

1. Service Description

GreenBrain is an AI-powered customer relationship management (CRM) platform designed for landscaping businesses. The platform provides conversational scheduling, invoicing, client management, and business intelligence tools.

2. Account Responsibilities

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the security of your account credentials.
You are responsible for all activity that occurs under your account.
You must notify us immediately if you suspect unauthorized access to your account.
You must be at least 18 years old to use the service.

3. Acceptable Use

You agree not to:

Use the service for any unlawful purpose or in violation of any applicable laws.
Attempt to gain unauthorized access to other accounts or our systems.
Upload malicious code, viruses, or any harmful content.
Use the service to send spam, unsolicited messages, or harassing communications.
Reverse engineer, decompile, or attempt to extract the source code of the service.
Resell or redistribute the service without our written consent.

4. Beta Status

GreenBrain is currently in beta. The service is provided on an "as is" and "as available" basis. Features may change, be added, or be removed without prior notice. While we strive for reliability, we do not guarantee uninterrupted or error-free operation during the beta period.

5. Your Data

You retain ownership of all business data you enter into GreenBrain. We do not claim any intellectual property rights over your content. Our use of your data is governed by our Privacy Policy.

6. Payment Terms

GreenBrain is currently free during the beta period. When paid plans are introduced, we will provide advance notice and you will not be charged without explicit consent. Any future payment processing will be handled securely through Stripe.

7. Limitation of Liability

To the maximum extent permitted by law:

GreenBrain is provided "as is" without warranties of any kind, express or implied.
We are not liable for any indirect, incidental, special, consequential, or punitive damages.
We are not liable for any loss of data, revenue, or business opportunities arising from your use of the service.
Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless GreenBrain and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

9. Termination

You may stop using the service at any time. We may suspend or terminate your account if you violate these Terms or if we discontinue the service. Upon termination, you may request a copy of your data within 30 days by contacting us.

10. Changes to These Terms

We may modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
